Director of Government Compliance (Finance)

Summary

Fairbanks Morse Defense (FMD) is looking for a Director of Government Compliance to join our team. This position manages and directs the Government Compliance function across the FMD portfolio of companies, reporting to the Chief Accounting Officer. The Director will provide Government compliance expertise related to Federal Acquisition (FAR), Defense Federal Acquisition Regulation Supplement (DFARS) and Cost Accounting Standards (CAS). Principle Duties and Responsibilities

• Lead and manage an organization of remote employees charged with providing regulatory and compliance guidance and training to all FMD business units.
• Monitor and remain current with proposed and enacted government accounting regulations including FAR, DFARS and CAS. Assesses impact to FMD and work with management to implement new/modified regulations. Provides oversight and training to ensure ongoing compliance.
• Effectively resolve allegations and findings of FAR, DFARS, and CAS non-compliances and disputes concerning FAR, DFARS, and CAS while mitigating adverse company impact.
• Develop and maintain required CASB Disclosure Statements for all FMD business units.
• Advise the Chief Accounting Officer of the cost impact of proposed cost accounting practice changes by contract type and contracting activity, and whether the change is unilateral, desirable, or required. When required, provide the DCAA with General Dollar Magnitude/detailed cost impact analyses, and Disclosure Statement change pages.
• Provide FAR and CAS guidance to Accounting and Finance regarding FMD's indirect rate structures, expense pools, allocation bases, unallowable costs, and home office allocations.
• Responsible for assisting Accounting and Finance with the preparation and timely submittal of the annual Incurred Cost Proposal to the DCAA in the DCAA prescribed format.
• Develop effective professional relationships with the DCAA and DCMA and internal customers.
• As the primary point of contact for DCAA and DCMA regulatory and compliance audits, lead and coordinate company responses to audit questions and data requests.
• Responsible for overall implementation, coordination, and resolution of complex DCAA/DCMA negotiations.
• Provide support to external consultants and the outside public accounting firm as required.
• Assist functional management with the development and maintenance of compliant business systems (e.g., accounting, timekeeping, cost estimating, purchasing, MMAS, government property), to include policies, procedures and training.
• Provide training to company personnel regarding the identification, safeguarding, marking, and dissemination of Controlled Unclassified Information (CUI).
• Develop Cybersecurity Maturity Model Certification (CMMC) policies and procedures that conform to DFARS requirements and NIST SP 800-171 criteria.
• Execute the post-acquisition Integration Management Office Government Compliance checklist to identify compliance or regulatory practices and procedures, and any non-compliances or deficiencies.
• Lead and/or manage compliance with government portals such as SAM, PIEE, SPRS, and WAWF. Ensure that all SAM registrations remain active and contain current, accurate, and complete information.
• As an Empowered Official, oversee ITAR and EAR licensing (DSP-5, TAA, MLA), and maintain the DDTC registration. Ensure that products and technical data are properly classified under the ITAR or EAR.
• Oversee the Small Business Liaison Officers development of small business subcontracting plans and the timely submission of reports into eSRS. Ensure that small businesses are properly classified in accordance with SBA Size Standards.
• Complete and/or support the completion of customer representations and certifications.
• Maintain subcontractor flow-down terms and conditions to include all mandatory and desired clauses.
• Other duties and special projects, as assigned.

Qualifications and Educational Requirements

• Must have at least a bachelor's degree and a minimum of 10-15 years of relevant experience in a government contracting environment dealing with FAR, DFARS and CAS.
• Experience resolving non-compliances resulting from DCAA and DCMA pre- and post-award audits, as well as business system audits.
• At least 5 years of experience leading a team
• Strong leadership and mentoring skills.
• Experience in developing and training employees in government contracting matters.
• Experience in developing forward pricing rates and budgets.
• Must have knowledge of regulatory requirements including GAAP, FASB, etc.
• This position requires access or potential access to Unclassified Naval Nuclear Propulsion Information, which is Not Releasable to Foreign Nationals (NOFORN) data. Therefore, to meet NOFORN requirement, you will have to provide proof of US Citizenship and attest that you do not have dual citizenship. Acceptable proof of US Citizenship is a US Passport, US Birth Certificate or Naturalization Certificate.
